Sexual Assault

Sexual assault is having sexual intercourse with another person without their consent. The offence is regarded by the courts as a serious offence and upon conviction it would be exceptional for an offender to receive a sentence other than full-time imprisonment.

Act of Indecency

The offence is committing an act of indecency with or towards another person. An indecent act is one which right minded persons would consider to be contrary to community standards of decency.

Aggravated Act of Indecency

The offence of aggravated act of indecency is committing an act of indecency in circumstances of aggravation. The Crimes Act provides that a person is “under the authority of another person” if the person is in the care, or under the supervision or authority, of the other person.

Aggravated Indecent Assault

Aggravated indecent assault is an assault on another person, in circumstances of aggravation, which includes an act of indecency at the time of, immediately before or immediately after the assault.

Aggravated Sexual Assault

Aggravated sexual assault is sexual intercourse with another person without their consent, knowing that they have not consented and in circumstances of aggravation.

Aggravated Sexual Assault in Company

This offence is regarded as among the most serious offences. Upon conviction a full-time custodial sentence is highly likely.

Assault with Intent to have Sexual Intercourse

Assault with intent to have sexual intercourse is, with the intention to have sexual intercourse with another person, intentionally or recklessly inflicting actual bodily harm on that person or a third person or threatening to inflict actual bodily harm on the other person or a third person by means of an offensive weapon.
