Family provisions after a testator dies
The Succession Act 2006 provides family members an opportunity to make a claim within 12 months of death on the estate of a deceased family member, if after advice, they believe that they were inadequately provided for by the deceased in their will. We help clients understand their rights in this area and try and negotiate a suitable outcome with the executors of the estate and other beneficiaries.
You should avoid going to Court to keep legal costs down. If the matter is heard by a Judge in the Supreme Court, all aspects of the relationship between the family member and the deceased will be investigated, the financial means of the family member and the size of the estate.
